Ah, right. So, in this context, a Strict Constructionist would be someone who would classify the story as hard SF or otherwise solely by reference to the text as it is written. Hartwell and Kramer would do otherwise. I can see what additional information a judge might use but I’m not at all clear what the editors could use. The position of the moon?

FYI I think they were using “strict constructionist” not as a critical term but in analogy to its American legal sense (http://en.wikipedia.org/wiki/Strict_constructionism).
